TERMS OF SERVICE

1. General

By visiting, accessing, using or purchasing through the Asteria Elite website, you agree to these Terms of Service, our Privacy Policy, Shipping Policy and Return Policy.

If any provision of these Terms conflicts with mandatory consumer protection laws applicable to you, the mandatory legal provision will prevail. The remaining provisions will continue to apply.

The Asteria Elite website is powered by Shopify. Any contract for the sale of products is entered into directly between the customer and Asteria Elite.

2. Account and Website Use

You are responsible for ensuring that the contact, billing, delivery and payment information you provide is accurate, complete and current.

You are responsible for maintaining the security of your account credentials. If you become aware of any suspicious or unauthorized activity relating to your account, you should contact us as soon as reasonably possible.

Fraud, impersonation, malicious software, unauthorized automated data collection, bot activity, attempts to bypass website security, spam, intellectual property infringement or conduct that may harm Asteria Elite, the website or other users is prohibited.

Asteria Elite may restrict or suspend access to the website or an account where misuse or fraudulent activity is reasonably suspected. This does not affect any mandatory rights arising from an existing purchase contract.

3. Products, Natural Stones and Handmade Characteristics

Many Asteria Elite products are handmade and contain natural stones.

Natural stones may vary in color, veining, pattern, transparency, shade, texture and surface appearance. Handmade products may also contain minor variations in measurements, bead placement or arrangement that do not alter the essential characteristics of the product.

Where the product remains consistent with its description and essential characteristics, variations resulting naturally from handmade production or natural materials will not, by themselves, constitute a product defect.

We make reasonable efforts to display our products as accurately as possible. However, slight color or appearance differences may occur due to screen, device, lighting or display settings.

References to the traditional, symbolic or cultural meanings of natural stones are provided for general informational purposes only. They do not constitute medical advice, diagnosis, treatment or a guarantee of any health outcome.

4. Product Use and Care

The lifespan and condition of jewelry depend on how it is worn, handled, stored and maintained.

To the extent permitted by applicable law, Asteria Elite is not responsible for damage caused after delivery by misuse, failure to follow care instructions, impact, excessive pulling or stretching, chemicals, perfumes, cosmetics, unsuitable cleaning methods or similar external factors, unless the damage results from a defect that existed at the time of delivery.

To assess the nature of a reported issue, we may reasonably request photographs of the product, order information and, where necessary, return of the product for inspection.

5. Prices, Discounts and Promotions

For orders placed through our Türkiye retail market, prices displayed at checkout include applicable taxes, and standard domestic shipping within Türkiye is free.

Prices, discounts and promotions may be changed prospectively at any time.

A price change made after an order has been completed will not, by itself, alter an already concluded order.

Specific promotions, discount codes, gifts and campaigns may be subject to additional terms disclosed at the time of the promotion.

Where clearly stated in the relevant campaign terms, a complimentary promotional or gift item supplied with an order may be required to be returned if the entire qualifying order is returned.

6. Obvious Pricing, Technical and Content Errors

Technical faults, data transmission errors or obvious mistakes may occasionally cause an incorrect price, discount, stock quantity or product information to appear on the website.

Where an obvious and objectively identifiable error is discovered, we will inform the customer.

If the order cannot reasonably be fulfilled under the correct terms, the order may be cancelled in accordance with applicable law and any amount already paid will be refunded.

This provision does not give Asteria Elite the right to arbitrarily cancel valid orders placed at a correct and valid price.

7. Orders and Security Checks

An automated acknowledgement that your order has been received confirms that the order information has been successfully submitted.

Orders may be subject to payment verification, stock availability, delivery checks and fraud or security review.

An order may be declined or cancelled where payment cannot be verified, there is reasonable evidence of fraud, an unauthorized payment method has been used, there is an obvious pricing or technical error, a legal restriction applies, or fulfilment has become objectively impossible.

Where payment has already been collected, any refund due will be processed in accordance with applicable law.

Asteria Elite may restrict unusually large retail orders or orders that reasonably appear to be intended primarily for commercial resale and may direct such customers to our wholesale sales channel.

8. Payments and Chargebacks

Payments may be processed through Shopify and/or authorized third-party payment service providers.

In the event of a chargeback, unauthorized-payment allegation or suspected fraudulent transaction, Asteria Elite may provide lawful evidence to the relevant payment provider, financial institution or authority, including order records, delivery information and customer communications.

You may not use a payment method that you do not own or are not authorized to use.

9. Shipping and Delivery

Orders are normally prepared within 1–3 business days.

Delivery times depend on the destination, carrier and local conditions. Estimated delivery times may also be provided in our Shipping Policy.

For Türkiye, domestic deliveries generally take approximately 1–5 business days after dispatch.

Delivery times are estimates and may be affected by public holidays, exceptional order volumes, weather conditions, natural disasters, customs procedures or other events outside our reasonable control.

Where required by applicable law, Asteria Elite remains responsible for loss or damage during transit until the goods are delivered to the customer.

Customers are responsible for providing an accurate and complete delivery address and a reachable telephone number.

If an order is returned because of an incorrect or incomplete address, refusal of delivery or another circumstance attributable to the customer, any new shipping cost required for re-dispatch will be communicated to the customer and agreed before re-shipping.

10. Right of Withdrawal and Returns

Any mandatory rights relating to withdrawal, returns and defective goods remain unaffected.

The procedure, time limits, return carrier and any legally permitted exceptions to the right of withdrawal are governed by our Return Policy and applicable law.

Where legally permitted, products genuinely made according to a customer's specific instructions or personal requirements may be excluded from the right of withdrawal.

Following a valid withdrawal notice, the customer must return the product within the period and according to the procedure required by applicable law.

Nothing in this section is intended to restrict any mandatory consumer right that cannot legally be excluded or limited.

11. Defective Products

If a product is legally considered defective, all mandatory consumer rights under applicable law remain unaffected.

Natural variations in color, veining, pattern, shade or texture, and normal variations arising from handmade production, do not by themselves constitute a defect where the product remains consistent with its description and essential characteristics.

Damage caused after delivery by misuse, impact, improper care or external factors is not attributable to Asteria Elite to the extent that such damage did not result from a defect existing at the time of delivery.

Any mandatory remedies available to consumers for defective goods remain unaffected.

12. Intellectual Property

The Asteria Elite name, logo, product designs, photographs, videos, product descriptions, graphics, written content and other website materials may be protected by applicable intellectual property laws.

Without our prior written permission, you may not commercially reproduce, republish, copy or use our content for the purpose of selling products, creating third-party product listings or otherwise exploiting Asteria Elite content.

Automated scraping, bulk copying or extraction of our product content for commercial purposes is prohibited.

Viewing website content for personal and non-commercial purposes does not transfer any intellectual property rights to you.

13. Reviews and User-Submitted Content

If you voluntarily submit a product review, photograph or other content to us, you permit Asteria Elite, to the extent allowed by applicable law, to use that content in connection with the promotion of Asteria Elite and its products.

You retain any rights that cannot legally be transferred or waived.

You must not submit content that infringes another person's intellectual property rights, privacy rights, personality rights or other legal rights.

We may remove content that is unlawful, spam, threatening, fraudulent or infringes third-party rights.

14. Third-Party Services and Links

The website may operate in connection with third-party services including Shopify, payment providers, logistics providers and other service providers.

To the extent permitted by applicable law, Asteria Elite is not responsible for the independent content, practices or systems of third parties that are outside our reasonable control, except where responsibility cannot legally be excluded.

15. Changes to the Website and Services

Asteria Elite may prospectively modify, remove or update product ranges, website content, design, promotions and website functionality.

Such changes will not retrospectively remove rights already acquired by a customer under an existing purchase contract.

16. Limitation of Responsibility

Nothing in these Terms excludes or limits any liability of Asteria Elite that cannot lawfully be excluded or limited, nor does it remove any mandatory consumer rights.

To the extent permitted by applicable law, Asteria Elite will not be responsible for losses arising solely from internet outages, third-party platforms, payment systems or other external services where such loss is not caused by Asteria Elite's own act, omission or legal responsibility.

17. Force Majeure and Events Beyond Our Control

Natural disasters, war, government action, widespread infrastructure or communications failures, strikes, epidemics, exceptional transportation disruption and similar events outside the reasonable control of the parties may temporarily affect the availability of services or delivery.

Any statutory rights to cancellation, refund or other remedies that apply in such circumstances remain unaffected.

18. Governing Law and Dispute Resolution

For consumer transactions in Türkiye, the laws of the Republic of Türkiye apply.

Consumers in Türkiye retain their legal right to apply to the competent Consumer Arbitration Committees, Consumer Courts and other legally authorized bodies.

For customers outside Türkiye, nothing in these Terms excludes any mandatory consumer protection rights or jurisdictional protections that apply under the law of the customer's country of residence where those rights cannot legally be waived.

No provision of these Terms will be interpreted as unlawfully restricting a consumer's right to apply to a competent court, authority or dispute-resolution body.

19. Changes to These Terms

Asteria Elite may update these Terms prospectively to reflect changes in law, business operations or the Services.

Updated Terms will apply from the date they are published or from another effective date clearly stated in the updated Terms.

Changes will not retrospectively remove mandatory rights arising from orders already concluded.
